Conflicto de competencia suscitado entre el Juzgado Octavo Penal Municipal de Cúcuta y el Juzgado Segundo Civil Municipal de Floridablanca (Santander).
La controversia se fundó en las diferentes interpretaciones que hicieron los despachos involucrados del factor territorial.
Considera la Corte que el juzgado competente para resolver la acción de tutela es el de la ciudad de Cúcuta, porque fue el que a prevención eligió el accionante y al que le fue asignado el trámite del proceso en primera instancia.
Se dirime el conflicto con la remisión del expediente al Juzgado Octavo Penal Municipal de Cúcuta, para que asuma de manera inmediata y sin dilaciones el conocimiento del asunto de la referencia.
